A New York judge has ruled that a lawsuit challenging the results of the 2024 presidential and U.S. Senate elections in Rockland County may proceed to the discovery phase.

The case, brought by the nonprofit SMART Legislation, seeks a full hand recount of ballots in both races. The group alleges statistical anomalies and discrepancies in certified vote totals, particularly concerning votes cast for independent Senate candidate Diane Sare.

Sworn affidavits from voters claim votes were not properly counted, while a statistical analysis cited in the complaint suggests the presidential results deviate sharply from expectations based on prior elections. In multiple districts, results showed voters backing a Democratic Senate Kirsten Gillibrand alongside a total of zero votes for Kamala Harris.

The court’s decision allows the plaintiffs to begin collecting evidence and conducting depositions. A recount could impact certified results or uncover broader election administration issues.
